I'm looking for a couple more sources for a Litigation Daily column inspired in part by the Court of Chancery's recent decision in Fortis Advisors v. Krafton. The topic: the ever increasing use of AI (particularly chatbots) has introduced a slew of new questions for lawyers about how chat logs might become part of a court record. Are we entering an era where directors and executives are using chatbots as a supplement to or substitute for their living, breathing counsel? How much of a concern is this for corporate litigators, and what are the areas they're most focused on right now in terms of how their clients' AI use might come up in court? Are there any other recent cases that have shed light on how courts are addressing these issues?
