Regulators are not sympathetic to "we didn't realise." 72% of organisations have deployed AI but only 24% have governance in place to support it. That gap isn't just a compliance risk. It's a privacy crisis waiting to happen. When AI is adopted without governance, privacy doesn't gradually erode, it collapses at the first point of failure. The incidents I'm watching unfold across industries share the same fingerprints: 1. Shadow AI - employees using personal AI accounts to process organisational and customer data, completely outside any data processing agreement or DPA coverage 2. Purpose creep - data collected with specific consent being fed into AI workflows that serve entirely different purposes. Lawful basis evaporates. 3. Agentic data sprawl - autonomous AI agents with broad tool access reading, copying, and acting on personal data across systems with no audit trail and no human in the loop 4. Model memory - sensitive inputs persisting in ways neither the organisation nor the individual ever anticipated or authorised 5. The explainability gap - when a regulator asks "why did your AI make this decision about this individual?", organisations with no governance have no answer The EU AI Act. GDPR Article 22 on automated decision-making, The UK ICO's AI auditing framework, and Australia's Privacy Act reform. .............these frameworks exist precisely because this was foreseeable. Privacy-by-design is not a pre-AI concept that became obsolete. It became more urgent. If your AI strategy doesn't have a privacy architecture sitting underneath it, you don't have an AI strategy. You have an incident waiting for a date. Build the governance OS first.
