Last week's FTC-NADA webinar was very interesting. Most of the FTC's answers were expected, but some were not. Here's my key observsations: 1. Doc fee must be included in the total advertised price; in all 50 states. Period. 2. It's okay if in-transit vehicles are advertised so long as they're, according to the FTC . . . "1 to 2 days out"?! This is obviously not how new car allocation works. I hope they clarify in their upcoming FAQ that it's fine so long as an expected delivery date is clearly and conspicuously disclosed. 3. No more "MSRP only" advertising (i.e., simply listing the MSRP with a disclaimer that it doesn't constitute the dealer's selling price). Every vehicle must have the total advertised price with all required fees and add-ons. 4. No more conditional rebates being backed into the price. The price must be one that 100% of consumers can get. But was a bit surprised that they said you can show a price with a conditional rebate deducted from it so long as its less prominent than the total price that all consumers can get. Not sure I'd be advising dealers to take advantage of this one though . . . 5. The "all-in" or total price that 100% of customers can get must be the MOST PROMINENT/LARGEST price listed in the advertisement. Encouraged to see that many dealers have already updated their sites to comply with these standards.
