Conciliation is often the first real engagement that employers have with a dispute once it has been referred to the Commission for Conciliation, Mediation and Arbitration (CCMA) or relevant Bargaining Council. Despite its informal nature, it remains one of the most important stages in the dispute resolution process and, if approached correctly, can save both time and costs. This guide by Senior Litigator Natalie Rautenbach sets out a practical overview of what to expect and how to approach conciliation effectively. Apr 2026Don’t Blame the Messenger A Health & Safety principle that saves more than feelings. In every workplace, especially high‑risk environments, honest communication is a critical safety control. Near‑miss reports, hazard identifications, and uncomfortable conversations are early warning signals, not inconveniences. Yet too often, the person who raises a safety concern becomes the problem. When people are criticised, sidelined, or quietly punished for speaking up, the message to the workforce is clear: “Silence is safer than honesty.” Ironically, that silence is far more dangerous than any reported hazard. Here’s what blame culture really does: Hazards go underground, Learning stops and Trust erodes Risk doesn’t disappear just because it isn’t reported, it simply resurfaces later as incidents, injuries, regulatory findings, or reputational damage. “Don’t blame the messenger” doesn’t mean no accountability. It means: Separating people from problems Focusing on system failures, not personalities Encouraging reporting without fear Treating safety information as a gift, even when it’s inconvenient Blaming the messenger is like shooting the smoke alarm for being noisy or getting angry at the forecast for predicting rain… The risk existed long before it was reported. Leadership response matters more than the investigation. When leaders thank people for speaking up and ask curious questions instead of accusatory ones, psychological safety grows. When leaders react defensively, silence follows, and silence is an answer. In Health & Safety, the person who raises the issue is rarely the problem. More often, they’re the first step to preventing tragedy... Broken silence is far safer than comfortable ignorance. How does your organisation respond when bad safety related news is reported? Cc me in, I’ll help you deal with it! oosthuizen@labournet.com
