9-0. Three weeks ago I called Montgomery v. Caribe a catalyst. Today the Supreme Court made it a scramble. Justice Barrett, writing for a unanimous bench, held that the F4A's "safety exception" includes freight brokers. Negligent hiring claims against 3PLs now proceed in state court. C.H. Robinson goes back to the Seventh Circuit as a defendant. Every broker in the country just woke up to a different operating environment than the one they went to bed in. What I had right in my April post: the legal standard moves from procedural ("did you check the boxes") to substantive ("should you have known"). The mortality curve isn't a cliff, it's a tide. The brokers who survive will be the ones who can prove what they knew, when they knew it, and why they made the call. What I had wrong: I expected a narrow ruling. 6-3 maybe. Justices Kavanaugh and Alito openly say in their concurrence that the case was closer than the majority suggests and they concurred anyway. No legal cavalry is coming. Three things follow from today: → Insurance markets reprice. The brokers who can document carrier selection with normalized, continuous, third-party-verified data will get rates the brokers who can't won't. → Shippers push risk down. Indemnification language gets sharper. The brokers who can prove their process win the freight. → Fraud surface contracts. Identity verification stops being a nice-to-have and becomes the legal foundation of every defensible carrier selection in the country. May 2026TORM ’s first quarter results show strong momentum at the start of 2026. TCE reached USD 286m and EBITDA reached USD 201m, with a net profit of USD 122m. We also declared a dividend of USD 0.70 per share. Since quarter end, the market has strengthened further. This has supported record booking levels and an upward revision of full year TCE guidance to USD 1,150 - 1,450 m.
