May 2026🔍 Is your cash pool leader a service provider, or a risk taker? It's one of the most overlooked questions in intragroup financing. And it directly drives the remuneration the CPL can defend at arm's length. OECD Chapter X sets the bar: function, risk, and substance determine the answer. In practice: ✅ A routine CPL (limited risk, no decision making capacity) earns a routine service fee. ✅ An entrepreneurial CPL (taking real credit, FX or liquidity risk) can earn a share of cash pool synergies. Most groups sit somewhere in between. Many label their CPL as "routine" but allocate it profits that look entrepreneurial. That mismatch is exactly what tax authorities are challenging. 💡 What we see: Audit pressure on CPL characterisation has intensified. Functional analysis is no longer a quick desktop exercise. Apr 2026FINMA's latest guidance (02/2026) on digital fraud risks contains a telling observation about transaction monitoring at Swiss banks. Based on a survey of 19 institutions, FINMA concludes that most rely on fixed absolute thresholds, suggesting "relatively unsophisticated systems" that make it "likely to be correspondingly difficult" to detect digital fraud. This is a clear regulatory signal. The underlying data makes it plain: KYC data is rarely integrated into monitoring, scenario-based detection is largely absent, and internal alert-to-MROS conversion rates vary between 12% and 78% across institutions. A tenfold difference in detection effectiveness is hard to explain away. The tools to close this gap exist today: - AI-powered detection models can move well beyond static thresholds; incorporating client risk profiles, behavioural baselines and fraud typology scenarios for more precise, context-aware alerts. - Generative AI is further transforming alert handling, reducing investigation time significantly. - In our experience at Zanders, the application of (Gen)AI in financial crime prevention has proven to make institutions more efficient and effective in their fight against financial economic crime.
